Another E1 recall: P90

The ongoing legal tussle between Cybergun and Echo1 USA Airsoft just chalked up another product being recalled by Jag Precision, the distributor of Echo1 products. According toThumpy's 3-D House of Airsoft, this time it's the E-90 (P90 replica) and dealers of this product in the USA will need to return the stocks they have pending litigation. This is part of the FN Herstal-Cybergun lawsuit against them.

Thumpy also says that another replica, which may be the M249 will also be recalled, but we don't know if the Echo1USA Ohio Ordnance Works M240B will be hit.

Dear JAG Precision Dealer,

The lawsuit that had been filed previously against JAG Precision has been amended to include the Echo1 E-90 (JP-32) JAG Precision is requesting that if you have any inventory new in the box, purchased from JAG Precision, that you cease all sales on these items and return them to us. Please let us know the quantity of items that you will be returning and we will be issuing credit to your account, once the items are received at our facility.

If and when more information about this case may be disclosed, we will release the information to you.

If you need any further information or have any questions, please contact your sales representative at JAG Precision.

Again we thank you for your cooperation and continuous support.

It's kind of hilarious because Tokyo Marui released the best ever Airsoft P90 more than 10 years ago. That gun was awesome for it's time.

Any news on a reason why? I adore my E90 but if it is going to explode in my face then I would love to know about it...

Trademark infringement......Big $$$ at stake for some poor schlub.....this is also why you see no more KWA Glocks, same issue. Sounds like FN wants their piece of the pie now. Seems I recall CA made a deal with FN on the P 90, sounds like E1 did not. Didn't VFC get into trouble with FN trades on their SCAR?

No, I believe VFC are licensed. The SCAR trade was E1/Jag Precision.
So, I believe the only "licensed trades" SCAR you can get is the VFC?

VFC scars got yoinked at shot show this year. Their line up of SCARS were pulled off (L and H models).

Yes. Don't misunderstand me, I'm not saying that Cybergun is in the wrong. All I'm saying is that from what I've gathered, FN couldn't really give a shit about E1/Dboys/whoever making unlicensed SCARs and such. It's Cybergun that is going to the effort to hammer down on those doing it.

Doesn't surprise me, to be honest. Cybergun's mentality seems to be to jump right to litigation instead of contacting E1 and those companies and offering a licensing deal.


No worries, looks like cyber gun is just protecting the intellectual property / trade mark s that it rightly paid for. Its kind of like when I'm in the Grocery store buying milk and bread and I see a welfare queen getting stuff ( and better) for free that I/ / we paid for.

The issue is likely that there are trades on the E90, they just aren't accurate trades. Although I am really getting tired of hearing about cybergun. There was a huge boycott cybergun movement a long long time ago, but they came back just fine, and now I wish they had just gone away...

Except, it's not just trademarks. It's trade dress. If it looks just like a P-90, it violates trade dress, even if it has labels that call it a "pink fluffy bunny distance-hugging projector".

Echo1 and JAG knew damn well that they were breaking the law when they imported and sold unlicensed copies of Cybergun's intellectual property, eg P90, SCAR, M249 and such. They knew damn well 2+ years ago when H&K and Glock made a big deal about trade dress. You 'tards that defend clones and illegal (becasue that is what they are) copies are why big companies don't get into airsoft more: the client base does not give two fucks about the company or it's rights, they just want a cheap copy of the company's product, and shazaam the original manufacturer.

Cybergun is in the right here,legally and morally. If someone was leaching off of your business internet connection to run a business that directly competed with your business, what would your reaction be? A nice letter asking them nicely to stop? Or a baseball bat to the tool sucker? Hmmm?
