I feel like someone scammed me, how can I get my money back?

Postby Chairmanlao » Sun Jun 06, 2010 5:07 pm

First off, if I'm posting in the wrong section, sorry. Please move it to the right section and let me know so I don't post in the wrong section.

So I saw this gun I wanted for a long time, and talked to the buyer. He seemed like any other buyer I have dealt with and asked for my address so he could send the gun (and to send 120.00 to this paypal). He also asked he I could send it as a "Personal". [I'm kicking myself for sending a paypal payment for a GOOD and sent it as a personal].
I did and I waited.
3 days, I asked if I could get an ETA he said he would weds (it was monday) because he waited for other payments to clears (he was selling alot of stuff).
5 days later, I ask for an ETA. No answer.
I wait another 2 days, I ask again, no answer.
I counted 10 business days and no product nor an answer from him.

EDIT: He lives in the US, and he never told me how long it would take. I started asking and he never replied.
What should I do?
Thanks.

No, I do not want to say the name out JUST yet....I'll wait the 4 extra business day for my damn gun...

I guess Paypal can't really help me because I didn't send it as a good....Thank goodness it was only 120.00 and not anything more....(Not saying 120 isn't alot, it is)

He committed fraud. Try to contact him again and inform him that you're prepared to take legal action if he doesn't refund your money or send you your goods as agreed. If he's smart, he'll probably give you a refund. Otherwise, you'll need to take action through either paypal or the police or let it drop. I'm no expert, so take my advice with a grain of salt, but I do know for sure that a crime was committed here and the law should back you up.

Edited for grammar.

Contact pay pal and dispute the transaction.

If this was an out of state transaction, good luck getting any type of prosecution effort. Most agencies wont touch an out of state action unless it involves a lot of $$$. In Marion county the DA would not go after stuff out of county.

To make it more "interesting", I, Chairmanlao, never bought the gun. (lol) MY F****** friend did, he used my account without permission. I mean, i'm mad that he used it (just pay me back ya know) but now THIS happened?
I already contacted him, AND paypal with unauthorize use AND in the message telling paypal this guy pretty much scammed me (my friend).

This is why you don't let you friends know or get on your paypal or any financial account. I don't want to be rude but be more cautious and don't let anyone else touch your accounts, even if its your friend or even family, they would understand if you just tell them straight up.

Yes. Why the hell would your friend have your paypal account information and be able to use it without your knowledge?

Just get $120 from your friend, have him worry about getting the damn gun.

No no, what your saying isn't rude. It is my fault after all.
I forget my passwords so I write them down in a book at my house. I left for a trip and he got into it.

UPDATE: Paypal isn't doing shit.

I know you already figured this out and I'm not saying it to be a phony pony. Whenever someone requests Pay pal to be personal rather than goods, I immediately stop communication. It's one indication of a sure scam (unless it's your good buddy of course).

Your "friend" has actually committed a criminal offense using your acct info for his benefit. I'm not suggesting that you have them charged, but you might use that info as leverage to obtain any $$ you are out and then I would evaluate the value of continuing any further association with this individual. Sorry you got burned.
